Terms of Service
These are the terms for working with Borg Sites. We have kept them fair and readable, no scary fine print. They explain what we offer, how billing works, who owns what, and the usual legal basics.

1. Accepting these terms
By using borgsites.com, requesting a quote, or buying any Borg Sites service, you agree to these Terms of Service and to our Privacy Policy. If you are agreeing on behalf of a business, you confirm you are allowed to do so. If you do not agree, please do not use our services.
2. What we offer
Borg Sites designs, builds, hosts and handles websites and brand visuals. Our services include:
- Design builds (one-time). A website or brand project we design and build for a single, agreed fee, based on its scope.
- Hosting & Care (monthly). A subscription that hosts your site and keeps it fast, secure, monitored and maintained. Eligible plans start with a $1 first month as an introductory offer, then renew automatically at the plan's stated monthly price until you cancel.
- Add-ons. Extra pages, content, features and services, priced individually.
- Domains. Registration, renewal and management through our Domain Dominion service.
We will always confirm the scope and price of your project in writing before we begin.
3. Billing, renewal and cancellation
- One-time builds are billed as agreed for your project, typically a deposit to start and the balance on completion.
- Monthly Hosting & Care plans bill monthly and renew automatically until you cancel. You can cancel at any time, and your plan runs to the end of the current billing month.
- The $1 introductory first month applies to your first invoice only, on eligible plans. After that first month, the plan renews at its stated monthly price.
- Annual services, such as Domain Dominion, are billed once a year.
- We do not refund partial months or unused time unless a refund is required by law. If we ever bill you in error, tell us and we will make it right.
4. Your responsibilities
So we can do our best work for you, you agree to:
- provide the materials, content and access we need, and to do so in good time,
- make sure everything you give us is accurate, and that you own it or have permission to use it, and
- use your site and our services only for lawful purposes.
You are responsible for the content you publish through your site.
5. Who owns what
- When you have paid in full for a one-time build, you own the final delivered website and the custom visuals we created for it.
- Borg Sites keeps ownership of its own underlying tools, code libraries, templates, systems and know-how, including anything we reuse across clients. Where your build includes these, you receive a license to use them as part of your site.
- While you are on a Hosting & Care plan, your hosting is provided as a license for the length of your subscription. Third-party components, such as fonts, stock assets or software, remain subject to their own licenses.
6. Acceptable use
You agree not to use Borg Sites, or a site we host for you, to break the law, infringe anyone's rights, send spam, host malware, or publish content that is unlawful, hateful or harmful. If content or a site breaches this section, we may suspend or remove it, and we will tell you why.
7. Availability and disclaimers
We work hard to keep your site fast and available, and our hosting runs on a global, resilient network. That said, we are a small studio, and we cannot promise the service will be uninterrupted or error-free, nor guarantee any particular result, search ranking or amount of business. Our services are provided "as is" and "as available", without warranties of any kind except those that cannot be excluded by law.
8. Limitation of liability
To the fullest extent the law allows, Borg Sites is not liable for indirect, incidental or consequential losses, or for lost profits, revenue or data. Our total liability for any claim relating to our services is limited to the amount you paid us for that service in the three months before the claim arose. Nothing in these terms limits any liability that cannot be limited by law.
9. Indemnification
You agree to cover Borg Sites for reasonable claims, damages and costs that arise from content you provide or publish, or from your misuse of our services or breach of these terms.
10. Governing law
These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. Any dispute relating to them will be handled in the state or federal courts located in New York.
11. Changes to these terms
We may update these terms from time to time. When we do, we will change the effective date shown at the top of this page. If a change is significant, we will make reasonable efforts to let clients know. Continuing to use our services after an update means you accept the revised terms.
